RedBird Development Group’s Data Privacy Framework Notice
Effective as of September 1, 2025.
RedBird Development Group LLC and its affiliate, RedBird X LLC (“RedBird X”) (together, “RDG”) comply with the EU-U.S. Data Privacy Framework (the “EU-U.S. DPF”), the UK Extension to the EU-U.S. Data Privacy Framework (the “UK Extension”), and the Swiss-U.S. Data Privacy Framework (the “Swiss-U.S. DPF” and, collectively, with the EU-U.S. DPF and UK Extension, the “Data Privacy Framework”). RDG has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (the “EU-U.S. DPF Principles”) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension. RDG has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles with regard to the processing of personal data received from Switzerland (the “Swiss-U.S. DPF Principles” together with the EU-U.S. DPF Principles, the “DPF Principles”). If there is any conflict between the terms of this Notice and the DPF Principles, the DPF Principles shall govern. Data Processed: RDG processes personal data on behalf of and at the instruction of its business clients. This data includes information about RDG’s clients, as well as their customers, end users, prospects, and employees, including contact information, demographic information, location, purchase and subscription histories, behavior information (e.g., product engagement, web engagement), marketing and customer success communications, employment information, and billing information. RDG also receives and processes personal data from third parties, including governmental agencies who publish public records and other publicly or generally available sources, including online websites and information that it purchases from commercial third-party data sources.
Purposes of Data Processing: Working at the direction of its clients, RDG provides strategic advice, business plan development, and hands-on execution. RDG’s in-house advisors and operating executives provide a comprehensive array of services and capabilities to its clients, ranging from strategic and operational value-creation initiatives to transaction and financial advisory services, including monetization strategies, mergers and acquisitions and capital raising. In addition, RedBird X incubates and scales new businesses and builds data, analytics, and AI products and services, which it licenses to clients, including those that are independent of RDG and its affiliates.
Inquiries and Complaints: RDG commits to resolve Data Privacy Framework Principles-related complaints about our collection and use of your personal data. You may direct any inquiries or complaints concerning our Data Privacy Framework compliance via email with the subject “Data Privacy Framework Inquiry” to privacy@redbirdcap.com. RDG will respond within 45 days. If you have an unresolved privacy or data use concern that we have not addressed satisfactorily, please contact JAMS, our U.S.-based third-party dispute resolution provider, at https://www.jamsadr.com/DPF-Dispute-Resolution, for more information or to file a complaint.
JAMS services are provided at no cost to you. If neither RDG nor JAMS resolve your complaint, under certain conditions more fully described on the DPF Website, you may be entitled to initiate binding arbitration through the Data Privacy Framework Panel when these other dispute resolution procedures have been exhausted. For more information on this option, please see Annex I of the EU-U.S. DPF Principles.
Third Parties Who May Receive Personal Data: RDG uses a limited number of third-party service providers (“Agents”) to assist us in providing our services to our clients. These third parties may access, process, or store personal data in the course of providing their services to us, including for data hosting and other processing and functionality. RDG complies with the DPF Principles for all onward transfers of personal data from the European Union, United Kingdom (and Gibraltar), and Switzerland, including the onward transfer liability provisions. RDG remains liable in cases where these Agents do not meet the obligation to process personal data in accordance with the DPF Principles or other applicable EU data protection requirements, unless we prove that we are not responsible for the event giving rise to the damage.
Your Rights to Access, To Limit Use, and To Limit Disclosure: EU, UK, and Swiss individuals have rights to access personal data about them, and to limit use and disclosure of their personal data. Where RDG is a processor of data on behalf of our clients, it is our policy to direct inquiries regarding access rights and choices related to the personal data directly to our clients. Per contractual arrangements with our clients, RDG, as a processor, operates with contractual limitations on disclosure or use of personal data. These contractual limitations restrict RDG’s ability to disclose personal data to third parties or to use personal data for purposes other than those specified in such contract. If you wish to request access, to limit use, or to limit disclosure, please email us with the subject line “DPF Rights Request” to privacy@redbirdcap.com. If you believe we received your personal data as a processor on behalf of one of our clients, please provide the name of the RDG customer who submitted your data to us in your email. We will refer your request to that customer, and will support them as needed in responding to your request.
Where RDG otherwise has received personal data about an EU, UK or Swiss individual from a third party pursuant to an agreement with that third party, RDG will honor requests to access and limit use and disclosure of such individuals’ personal data consistent with the DPF Principles. U.S. Federal Trade Commission Jurisdiction: The Federal Trade Commission has jurisdiction over RDG’s compliance with the Data Privacy Framework.
Compelled Disclosure: RDG may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
